Notice of Public Hearing – Irrigation Connections

Moroni City will hold a public hearing Thursday, October 19, 2023, at 7 p.m. to receive public comment regarding proposed Ordinance No. 2023-10-19 An Ordinance establishing a limited temporary land use regulation within the incorporated areas of Moroni City, State of Utah for the Moroni City Irrigation System Under Title 8 at the Moroni City Community Center, 80 South 200 West, Moroni, UT.

The City of Moroni will not accept any new applications for connections to its irrigation service system until it determines the maximum capacity of the well, delivery system and ability to provide adequate flows to properties within the City’s current area of

service of the irrigation service system.

ORDINANCE NO. 2023-10-19 AN ORDINANCE ESTABLISHING A LIMITED TEMPORARY LAND USE REGULATION WITHIN THE INCORPORATED AREAS OF MORONI CITY, STATE OF UTAH FOR THE MORONI CITY IRRIGATION SYSTEM UNDER TITLE 8.

WHEREAS, the City of Moroni, Sanpete County, State of Utah, a body politic, is a municipal corporation organized and established for the purpose of serving its residents; and

WHEREAS, the City of Moroni owns and maintains a pressurized irrigation system which provides irrigation water services to its citizens pursuant to its Irrigation Service Regulations located under Title 8, Chapter 5, et. seq.;

WHEREAS the City of Moroni desires to assure sufficient water capacity with adequate pressure to service various properties located within the City for irrigation purposes; and

WHEREAS, under authority of U.C.A. §10-9a-504, Moroni City finds it necessary to adopt this Temporary Land Use Regulation, to be in effect for a period not to exceed six months to limit the right to construct or purchase a new connection to the City’s irrigation system until the capacity and capabilities of the system can be determined; and

WHEREAS it is the obligation of the City of Moroni to protect the integrity, safety, and orderly growth of the community and the community’s irrigation water system to assure its ability to provide adequate services to the community; and

WHEREAS, the City did publish on the City’s web site and posting the proposed ordinance; and

WHEREAS, the City opened the meeting for verbal comments from the Community and Council; and

WHEREAS, notice of a public hearing regarding the adoption of this Ordinance was properly published; and

WHEREAS, the City Council finds that it is in the best interest of the City of Moroni to establish a temporary moratorium on any new connections to its irrigation system.

NOW, THEREFORE, IT IS HEREBY ORDAINED by the City Council of Moroni City, Sanpete County, Utah, that a temporary moratorium is imposed under Title 8, Chapter 5, Sections 2 and 3 of the Moroni City Ordinances as well as any other ordinances or engineering plans authorizing connection to the Moroni City Irrigation Service system as follows:

  1. Regulated Land. The regulated land shall be all land within or without the incorporated areas of the City of Moroni which is divided or which seeks to obtain a new connection to the City’s irrigation system.
  2. Effective Dates. The regulation shall become effective immediately and shall remain in force until rescinded or six months, whichever occurs first.
  3. Regulation. The City of Moroni will not accept any new applications for connections to its irrigation service system until it determines the maximum capacity of the well, delivery system and ability to provide adequate flows to properties within the City’s current area of service of the irrigation service system.
  4. Compelling Interest. The City Council hereby elects to issue this temporary land use regulation due to concerns related to potential inadequate pressurized water flows and substandard water system distribution throughout the Town. This moratorium is meant to assure that the City of Moroni is able to deliver adequate water with sufficient flows to provide those citizens who have already paid to connect to the irrigation service system with water, and to assure that the City has an adequate water management plan to deal with the above issues as it relates to new connections. Once the water management plan is established, the City of Moroni will welcome new connections if determined feasible and to establish the boundaries and limitations of the irrigation service system related to future connections.

BE IT FURTHER ORDAINED that this ordinance shall take effect immediately upon execution.
